Worker Protection Standard

The Michigan Department of Agriculture is the agency responsible for monitoring compliance with the Worker Protection Standard (WPS). WPS is a regulation which requires that growers provide protections to their agricultural workers and pesticide handlers to prevent exposure to pesticides.

These protections include, pesticide safety training, decontamination supplies, information about pesticide treated areas, use of label required personal protective equipment when applying pesticides, and emergency assistance in the case of a pesticide exposure.

If you feel you have not been provided the WPS protections you are legally entitled to, we encourage you to file a complaint with us using the Worker Protection Standard Complaint Form. Complaints can be filed anonymously. MDARD Inspectors will follow-up with complaints received through the form.

The WPS prohibits retaliation against agricultural workers or pesticide handlers for attempting to comply with WPS requirements, or for cooperating with state or EPA officials during a WPS inspection or investigation.

What is the Worker Protection Standard?

The Federal Agricultural Worker Protection Standard (WPS) is a federal law that mandates on-the-job protections for farm employees who work on the production of an agricultural commodity. Agricultural employers must provide WPS protections to their agricultural workers and pesticide handlers. These protections are meant to reduce the risks of illness or injury from pesticide exposure.

Some protections include ensuring workers and pesticide handlers have access to the following:

  • Pesticide safety training
  • Pesticide application and hazard information
  • Decontamination supplies

Does WPS apply to you?

WPS applies only when all of the following apply:

  • A pesticide is used on an agricultural establishment to produce an agricultural commodity, and
  • Agricultural workers and pesticide handlers receive monetary compensation, and
  • The pesticide’s label contains the following "Agricultural-Use Requirements" box:

    Use of this product only in accordance with its labeling and with the Worker Protection Standard, 40 CFR 170. This standard contains requirements for the protection of agricultural workers on farms, forests, nurseries, and greenhouses, and handlers of agricultural pesticides. It contains requirements for training, decontamination, notification, and emergency assistance. It also contains specific instructions and exceptions pertaining to the statements on this label about personal protective equipment, restricted-entry intervals and notification of workers.
