Corporations, Securities, and Commercial Licensing Bureau Files Complaint Against Proteccion Plenitud, Inc. D/B/A Assure For Life

The Michigan Department of Licensing and Regulatory Affairs, Corporations, Securities, and Commercial Licensing Bureau (“CSCL”) has filed a civil complaint against Proteccion Plenitud, Inc. d/b/a Assure for Life (“Assure for Life”) in the Oakland County Circuit Court for failing to comply with the requirements of the Prepaid Funeral and Cemetery Sales Act and selling prepaid funeral contracts without being registered.

According to CSCL’s complaint, the Florida-based Assure for Life has sold Funeral Assistance Plans to Michigan residents for a monthly membership fee. In return, Assure for Life promises to help coordinate and pay for funeral expenses for its members and identified beneficiaries. Assure for Life sells these plans using independent contractors who receive a sizable commission for the sales.

In Michigan, sellers of prepaid funeral contracts must be registered under the Prepaid Funeral and Cemetery Sales Act and must comply with consumer safeguards, including escrowing funds entrusted to them for the benefit of the contract beneficiaries.  Assure for Life is not registered to sell prepaid funeral contracts and does not escrow membership fees for the benefit of the contract beneficiaries.  In addition, Assure for Life pays its salespeople higher commissions than those allowed under the law.

CSCL’s complaint seeks an injunction to stop the unlawful sales of Assure for Life’s Funeral Assistance Plans in Michigan.

Consumers are encouraged to make informed decisions when making prepaid funeral arrangements, including verifying that the seller is licensed and that their funds are appropriately escrowed as required by law.
