AG Nessel Files Emergency Appeal to Reverse Parole of Convicted Murderer

LANSING – Today, Michigan Attorney General Dana Nessel filed an emergency parole appeal in the 30th Circuit Court in Ingham County to reverse the parole granted to Marcos Garcia Rayos, 45, currently incarcerated at the Saginaw Correctional Facility in Freeland. Rayos is scheduled to be released on parole on April 24, 2025. 

In Lansing in 1999, when he was 19-years old, Rayos and another man shot 15 year-old Isaac Rivera 19 times, killing him. At this time, Rayos had been only recently released from jail, serving sentences for convictions of breaking into a motor vehicle and possession of narcotics, the latest in many criminal convictions against Rayos. In 2000, Rayos pled guilty to Second-Degree Murder as a habitual offender and was sentenced that same year to 25-50 years’ incarceration. 

During his time incarcerated, Rayos received 72 misconduct offenses, including for violent assaults, spent significant time in administrative segregation as a result of his conduct, and remained at a level IV security classification for large portions of his incarceration. 

The Parole Board granted Rayos parole on January 2, 2025, ordering that he be released from the Saginaw Correction Facility on April 24, 2025. Attorney General Nessel has filed this emergency appeal on behalf of the sister of Isaac Rivera. 

“Mr. Rayos has only served just slightly more than his minimum term of incarceration relative to his significant sentence for the brutal killing of a 15-year-old boy,” said Nessel. “In our assessment, and that of the family of the boy he murdered, Rayos has not demonstrated proper rehabilitation, nor has he yet served an appropriate sentence for the crime he committed. He is not a suitable prisoner for the privileges of parole, and so we have filed an appeal of this decision to end his incarceration.” 

The Attorney General argues that the Parole Board’s decision to grant Rayos’ parole should be reversed.
