Project Statement

This request for proposals (RFP) is to solicit proposals from attorneys and law firms to serve as Special Assistant Attorneys General (SAAGs) to pursue litigation against manufacturers of Polychlorinated biphenyls (PCBs) for damages or impacts linked to PCBs on behalf of the State of Michigan through the Department of Attorney General (DAG).

PCB RFP Question and Answer

  • Question:

    1. Testifying experts are a [sic] essential part of any environmental or toxic tort lawsuit, will managing and propounding expert opinions, reports and discovery be part of the scope of work?
    2. How will experts be compensated?
    3. How will the State: 1) determine whether a particular expert has a conflict; and 2) resolve conflicts?

    Answer:

    See Section 3 of the Scope of Work, Section 4 of the Proposal Contents, and the SAAG Contract.

  • Question:

    1. What areas of scientific expertise (i.e. What experts) does the State anticipate will be necessary to prosecute the PCB cases?
    2. Will the State compile a list of experts in these technical fields for use by the law firms that are awarded the contracts?
    3. How will experts be vetted by the State? What parameters will be used to select experts?
    4. Will law firms that are awarded the contracts be authorized to select their own experts?
    5. Are their [sic] goals for awarding contracts to disadvantaged businesses including but not limited to small , women owned, minority owned, and veteran owned businesses?

    Answer:

    The SAAG is responsible for pursuing all claims and actions in connection with an approved litigation strategy against defendants approved by the Attorney General, which includes determining which experts or consultants are appropriate in consultation with the Department (see Sec 5.10 of the SAAG Contract).  The precise considerations for a proposed expert will depend on litigation strategy and the nature of the expertise sought. 

  • Question:

    1. Can you please clarify what the State means by "partnerships and strategic relationships" in the context of this RFP?
    2.  Can you please clarify what the State means by "bring significant value to the State" in the Context of this RFP?

  • Question:

    1. Are experts considered "subcontractors" for purposes of this RFP?

    Answer:

    Section 4.4 of the SAAG Contract addresses the assignment and subcontracting of services by SAAGs.  Section 4.12 sets forth the independent contractor status of the SAAGs.
