Draft Rule Language

Guide to the Proposed Revisions to the Marihuana Administrative Rules

This guide is intended to provide an overview and assist in the understanding of the proposed changes, offering brief descriptions of each rule and the changes that are being made to that rule. Many of the rules are being edited or reorganized to improve clarity.

These editing and reorganizational changes include consolidating related provisions, deleting duplicative provisions, changing from passive to active voice, reordering provisions to flow more logically, and general language cleanup. Michigan uses a strike/bold format to draft changes to an existing ruleset – existing language that is being deleted will be struck; new language will be in bold.

Proposed Changes to the Marihuana Rules

The CRA previously released a version of this document in May 2023 that listed a summary of proposed changes to the rules and solicited feedback from interested parties. This document has been updated to include a column indicating the status of the proposed change in the draft.

  • Left column: contains the summaries of proposed changes (as they were released in May 2023)
  • Center column: includes brief justifications for the proposed change (as they were released in May 2023)
  • Right column: Rule numbers in this column indicate where the change is being made or where a change pertaining to the same topic is being made. If the words “not included” are in the right column, that means the proposed change in the left column has not been included in the proposed rules.

What’s Next?

Once the public hearing has been held and the public comment period has ended, the CRA’s final rules – which may incorporate any edits suggested by the public – are sent to the Legislative Service Bureau (LSB) for formal certification.

After MOAHR legal certifies them, the rules are then sent to the Joint Committee on Administrative Rules (JCAR), a bipartisan state legislative committee made up of five members from the Senate and five members from the House.
