New Case Processing Forms


As indicated in our ListServe message of February 21, 2007, the Tribunal is transitioning to a system using a Proposed Scheduling Order for both property and non-property tax matters. The Proposed Scheduling Order has been revised and is provided here and on our Forms page for your review and use.

To further facilitate earlier management of pending cases, the Tribunal has created a Case Information Sheet and a Case Management Report and Scheduling Order.

The proposed scheduling orders will typically be submitted to the parties with the notice of docket number. The forms contain, in chronological order:
  1. Blanks for the parties' specific dates for naming of witnesses,
  2. The completion of discovery,
  3. The filing of dispositive motions,
  4. The filing of valuation disclosures, exhibit lists, stipulations of fact and dates after which the parties are available for a prehearing and hearing.
The parties wishing to utilize these forms are required to complete and return the order by the due date contained in the order. The proposed order will be reviewed and, if appropriate, entered by the Tribunal. Based on the parties' agreed-upon dates, the Tribunal will also enter an order scheduling a date certain for the filing of prehearing statements, trial briefs, exhibits, and court reporter notification. The hearing order will also provide dates for the conducting of the prehearing conference and hearing.

These scheduling orders will allow the parties to set their own time frame for the processing of their case to hearing rather than have the Tribunal set dates and monitor the parties' compliance with those dates. These orders should also reduce the need to file motions to compel discovery or request extensions of time or adjournments and issue default orders.

The Case Information Sheet assists administrative staff in the processing of cases by providing the information necessary for the processing of a petition on a cover sheet attached to the petition. The use of these sheets will allow us to process cases faster by eliminating the need for administrative staff to review the petition to find that information.

The Case Management Report and Scheduling Order will also assist administrative staff in the processing of cases. The reports will replace counsel conference summaries and provide verification by both parties of the information provided in the Case Information Sheet and allow for the earlier assignment of cases to Tribunal judges.

The Tribunal is currently scheduling cases through the use of the property and non-property scheduling orders noted above. In addition, the Tribunal will be prioritizing the processing of those cases that utilize the Case Information Sheet and the Case Management Report and Scheduling Order.

In those cases where the parties fail to file a Proposed Scheduling Order (i.e., the Property or Non-Property Scheduling Order or the Case Management Scheduling Order), the Tribunal will either issue its own scheduling order or set a date for the conducting of a scheduling conference to establish a schedule for the processing of the case.
