Subdivision, Condominium and Land Division Construction (On--Site Water Supply and Sewage Disposal)

Projects involving a subdivision or site condominium project utilizing individual, on-site, subsurface disposal systems or individual wells are required to submit preliminary plat drawings for review and approval by local health departments or in some cases by the Michigan Department of Environmental Quality (MDEQ).

A. NAME OF PERMIT OR APPROVAL:

Preliminary plat, site condominium and land division approvals

Land Division Act, Public Act 288 of 1967, as amended

Condominium Act, Public Act 59 of 1978, as amended

C. APPLICABLE REGULATION:

Michigan Administrative Code, Rules Administered by MDEQ, WB

Part 4, Subdivisions of Land (R 560.401 - 560.428)

D. MICHIGAN BUSINESS ONE STOP:

The Michigan Business One Stop (One Stop) www.michigan.gov/business is a tool designed to allow businesses to interact with the State of Michigan. The tool offers:

  • a set of screening questions based upon your business sector to identify permits, licenses and registrations that may be required to do business in Michigan.
  • an option to pay fees online. For many programs, you can pay your business license fee in One Stop through use of an online form and shopping cart.
  • many online permit applications and renewals. When starting a new business and registering in One Stop, you will need to identify a business sector (also known as a NAICS Code). You can find your code at www.naics.com, select "Code Search."  After entering this code in One Stop and answering some screening questions, links to relevant permit applications will automatically be available in your newly created workspace. One benefit of accessing applications through One Stop is that you will receive status messages throughout the application process.

Using the One Stop provides many benefits to businesses in Michigan. By conducting your business through One Stop you can organize your State of Michigan transactions in one place. E. SUMMARY OF PERMIT/APPROVAL PROCESS:

 1.  Applicability (activities that require the permit)

Subdivisions, site condominiums, and land divisions less than one acre intended to be served by individual, on-site, sewage systems or individual wells.

 2.  Pre-Application Requirements

Site suitability approval in accord with the requirements of MDEQ rules must be obtained from the local health department having jurisdiction for proposed subdivisions, site condominiums, and land divisions less than one acre if public sewer and water are not available and accessible.

 3.  Application Submission Requirements

Three copies of the subdivision or site condominium drawing along with a site report confirming site suitability must be submitted to the local health department by the project engineer or surveyor. For land divisions less than one acre, data supporting suitability must be available prior to the governing body issuing a building permit.

 4.  Procedures and Time-Frame for Obtaining Permit or Approval

The engineer or surveyor for the proprietor is responsible for gathering supporting information documenting site suitability including soils and water well quantity, quality, and protection. This information is summarized in a site report and submitted along with

The proposed subdivision or site condominium drawing to the local health department having jurisdiction. Approvals are granted where supporting information confirms that the provisions of the rules are met.

Review fees are established by the local health department having jurisdiction.

 7.  Appeal Process

The rules establish a variance procedure. Ultimate appeal would be to the circuit court of the county of which the appellant is a resident or to the circuit court of Ingham County.

 8.  Public Input Opportunities

The public typically learns about the proposed development of a proposed subdivision, site condominium, or land division through newspaper notices posted by the local municipality under zoning and land use ordinances, and this venue provides the best opportunity for public input. The public may also offer comments to the MDEQ regarding these proposals although there is no legislative mandate establishing a procedure for public comments.
