Resolution #1997-04 (Adopted 1/23/97) - Request for Rule Making Form; begin to draft Administrative Rules

RESOLUTION NO. 1997-04 (Adopted 1/23/97)

 

A Board Resolution Authorizing And Directing The Interim Executive Director, The Executive Director Of The Board And The Legislation And Rules Subcommittee Of The Board To Prepare And Submit A Request For Rule Making Form To The Governor's Office Of Regulatory Reform And Begin Meeting To Draft Rules For The Board's Review And Approval For Promulgation Under The Act.

 

WHEREAS, the Michigan Gaming Control Board ("the Board") is required by Section 4 (c) of the Michigan Gaming Control and Revenue Act ("the Act") to promulgate rules necessary to implement the Act pursuant to the Administrative Procedures Act of 1969, MCL 24.201 to 24.238; and,

 

WHEREAS, it is necessary for the Board to prepare and submit a completed Request for Rule Making form to the Governor's Office of Regulatory Reform to obtain approval to commence the rule making process; NOW THEREFORE,

 

IT IS HEREBY RESOLVED AS FOLLOWS:

  1. That the Interim Executive Director and the Executive Director of the Board are authorized and directed to immediately prepare and submit the Request for Rule Making form prescribed by the Governor's Office of Regulatory Reform for approval to commence promulgation of rules pursuant to Section 4 (c) of the Act;
  2. That the Interim Executive Director, the Executive Director of the Board and the Legislation and Rules Subcommittee of the Board are directed to begin meeting to draft proposed rules which are necessary for timely, proper and effective implementation, administration and enforcement of the provisions and requirements of the Act;

  3. That the Interim Executive Director and the Executive Director of the Board are authorized to contract with and engage the services of qualified private consultants to assist the Board in drafting and promulgating rules that are necessary to properly implement the Act; and,

  4. That the Legislation and Rules Subcommittee of the Board shall submit proposed rules to the Board necessary for implementation of the Act, and recommend the approval and promulgation of such rules pursuant to the Board's statutory power and duty under the Act.
