Resolution #1998-01 (Adopted 1/22/98) - Recognize Code of Ethics in PA69 of 1997

RESOLUTION NO. 1998-01 (Adopted 1/22/98)

 

A Board Resolution And Order Rescinding And Vacating The Interim Code Of Ethics Passed By Earlier RESOLUTION AND ORDER NUMBER 1997-07 And Recognizing The Preemption Of Same By The Legislative Enactment of MCL 432.201, Et. Seq., As Amended.

 

WHEREAS, the Michigan Gaming Control Board ("the Board") passed RESOLUTION AND ORDER NUMBER 1997-07 as an interim code of ethics to govern and guide the conduct of its members, employees and agents as well as licensees and applicants for licenses under the Michigan Gaming Control and Revenue Act; and,

 

WHEREAS, the Legislature of the State of Michigan has subsequently enacted an amendment of the Michigan Gaming Control and Revenue Act, effective July 17, 1997; and,

 

WHEREAS, the above legislative amendment contains provisions which essentially duplicate the Board's interim code of ethics and govern and guide the ethical conduct of members, employees and agents of the Board as well as licensees and applicants for licenses under the Michigan Gaming Control and Revenue Act; and,

 

WHEREAS, the interim code of ethics has been effectively preempted by such statutory amendments; and,

 

WHEREAS, the amendatory legislation provides a more comprehensive standard of conduct than the interim code of ethics; and,

 

WHEREAS, the purposes of the original interim code of ethics have been served and are no longer necessary; and,

 

WHEREAS, continued application of the interim code of ethics may conflict with and cause confusion regarding the provisions in the Michigan Gaming Control and Revenue Act, as amended, which governs ethical conduct; NOW THEREFORE,

 

IT IS HEREBY RESOLVED AND ORDERED that the interim code of ethics previously adopted by Resolution and Order Number 1997-07 shall be and is hereby rescinded and vacated, and has no further force or effect.
