Right-of-Way Construction Permits

This area has the responsibility for managing the department's Statewide Right-of-Way boundaries pursuant to Act 200 of 1969 (Driveway, Banner and Parade act), 368 of 1925 (Encroachment Act) and 106 of 1972 (Highway Advertising Act, Section 252.311a Vegetation Removal).

As part of the Utility Coordination and Permits Section of MDOT, this unit acts as a liaison between MDOT and internal departmental agencies, Federal Highway Administration, Utility companies and permit applicants as it relate to building, constructing and working between the operational right-of-way boundaries/lines.  The sections responsibilities include general permit program operations and procedure for internal and external implementation, monitor compliance and develop responses to legislative, citizen and federal issues.  Coordinate the review and approval of right-of-way construction permits between MDOT and other departmental agencies and Federal Highway Administration for safety and engineering analysis.  Act as a resource for complex construction permit related issues.  Oversee MDOT contract between the Department of Information Technology (DIT) and the established cellular communication company for review, installation, and timelines established by the State of Michigan Statewide contract.

Frequent permit requests in the Operational Right-of-Way (Freeway and Non-Freeway):

  • Driveways (Residential, Commercial, and Field)
  • Utility Permits (New Installations and Maintenance Work)
  • Environmental (Soil Boring, Monitor Wells, and Remediation Cleanup)
  • Parades
  • Banners
  • Inspections
  • Land Surveys

A majority of these permits request will be administered through the Transportation Service Centers (TSC) offices.
