Requirements for Districts Not Making AYP

The requirements for districts that do not make AYP are similar to the requirements for individual schools. Districts that fail to make AYP for two or more consecutive years are identified for improvement and are subject to the following requirements:

Districts Not Making AYP for Two Years. A district that does not make AYP for two consecutive years is identified for improvement and must take the following steps to improve student academic achievement:

  • Develop a district improvement plan in consultation with parents, school staff, and any outside expert who is providing assistance.
  • Implement the improvement plan by the beginning of the school year following the year the district was identified.
  • Spend at least 10 percent of its Title I allocation each year on professional development that directly addresses the achievement problems that caused it to be identified.

The district may request assistance in developing and implementing its improvement plan from the Michigan Department of Education, which must provide or arrange this assistance before it takes any corrective action with respect to the district.

Districts Not Making AYP for More Than Two Years. After the Michigan Department of Education has provided assistance to the district in developing and implementing its improvement plan, the Department may take corrective action with respect to the district at any time. The Department must make information on the corrective action it takes available to parents and the general public.

If a district fails to make AYP for four consecutive years, the Michigan Department of Education must take at least one of the following actions:

  • Withhold program funds or reduce administrative funds.
  • Implement a new research-based curriculum and provide appropriate professional development for all relevant staff.
  • Replace the district staff who are relevant to the failure to make AYP.
  • Remove particular schools from the district's jurisdiction and make other arrangements to govern and supervise these schools.
  • Appoint a receiver or trustee to administer the district in place of the superintendent and school board.
  • Abolish or restructure the district.
  • Authorize students in the district to transfer to a higher-performing school in another district and provide or pay for transportation with Title I funds from the district subject to corrective action. If the Department chooses this action, it must also take at least one of the other six actions.

Status of Identified Districts That Subsequently Make AYPIf a district that has been identified for improvement makes AYP for one year, the Michigan Department of Education may delay taking corrective action for one year. If an identified district makes AYP for two consecutive years, the Michigan Department of Education is not required to take any further corrective action.
