The Michigan Department of Community Health (MDCH) has summarily suspended the medical license of Daniel C. Luebke, M.D., due to his misdemeanor conviction in the 57th Judicial District Court, Allegan County, Michigan. Luebke failed to report the conviction to MDCH as required by the Public Health Code.

On January 12, 2004, Luebke was convicted of Operating While Ability Impaired by Drugs and Attempted Police Officer-Fleeing-Fourth Degree. The convictions stemmed from Luebke’s arrest for erratic driving and subsequent positive drug screen for controlled substances. It was later learned that Luebke engaged in a fraudulent scheme to obtain controlled substances through his employer.

For his Operating While Ability Impaired by Drugs conviction, Luebke was sentenced to 70 days in jail, placed on probation with condition for a period of six months, and ordered to pay fines, costs and fees totaling $700.00. For his Attempted Police Officer-Fleeing-Fourth Degree conviction, Luebke was sentenced to 35 days in jail and ordered to pay $350.00.

On June 17, 2004, MDCH issued an order immediately suspending Luebke’s license pursuant to the Public Health Code, which provides for the mandatory summary suspension of a health professional’s license upon the conviction of a misdemeanor involving the illegal delivery, possession, or use of a controlled substance. An administrative hearing will be scheduled to address the status of Luebke’s medical license.
