Certificate of Need Annual Web-Based Survey

The Department of Community Health released the 2008 Certificate of Need (CON) Web-Based Survey in March 2009.  This online survey is designed to improve and expedite the data reporting process to the State as required by Part 222 of the Public Health Code.    All completed 2008 surveys were due to the Department by May 4, 2009.

The information provided is used by the Department in conducting its review of future CON applications as well as determining compliance with the terms and conditions of already approved projects.

In accordance with MCL 333.22237 and the various applicable Review Standards, the Department will not issue a decision on any Certificate of Need application after May 4, 2009, if the applicant facility has not completed and submitted the required 2008 annual survey. 

In addition, the Department is issuing civil fines of $2,500 for delinquent surveys not submitted by June 2009, and an additional civil fine of $1,000 for each subsequent month a survey is late.  Please note the Department hopes to avoid any enforcement action, but must stress the importance of submitting timely survey data.  The Department routinely will post a report demonstrating the facilities required to submit surveys and those that are and are not in.
