Explanation of Nursery Stock Dealer and Growers License Types

A nursery license is required when growing nursery stock for sale; and, when selling or offering nursery stock for sale. Nursery stock means propagated or wild, hardy perennial or biennial trees, shrubs, vines, or plants, cuttings, grafts, scions, buds, bulbs, rhizomes or roots thereof, and other plant parts capable of propagation.  Nursery stock includes trees, shrubs, herbaceous perennials, rose bushes, mums plants, small fruit plants, rhubarb, asparagus, hardy bulbs and winter-hardy herbs.

A nursery license is not required for growing or selling annual plants, tropical plants, field crop seed, vegetable seeds, flower seeds, corms or tubers.

  1. Nursery Stock Dealer License $100 fee – Covers the sale of nursery stock at permanent business locations, other than at the growing location; and for LANDSCAPERS planting or transplanting nursery stock. 
  2. Nursery Stock Dealer Market License $100 fee – Covers the sale of nursery stock at temporary business locations such as at roadside markets, farmers’ markets, craft shows, from a truck, other vehicle, or from a market stall.
  3. General Nursery (Grower) License $100 fee – For growers of propagated or wild nursery stock. All growers are required to have their nursery stock inspected by MDA.  
  4.  Small-scale Grower License $40 fee - For growers with less than 200 square feet of utilized greenhouse growing space or less than 1/4 acre of nursery stock.  Requires evaluation by MDA inspector.
  5. Small-scale Grower Market License $40 fee – Covers the sale of nursery stock produced by a Small-scale Grower at temporary business locations such as at roadside markets, farmers’ market, craft shows, from a truck, other vehicle, or from a market stall.  Requires evaluation by MDA inspector.
