2(ee) Recommendations

Registrants are encouraged to submit copies of 2(ee) recommendations to MDA for reference.

24(c) Special Local Needs (SLN) Registrations

Registrants must complete and submit the EPA SLN registration form 8570-25.  In addition, the registrant must describe in detail the "special local need" and why their product will satisfy this need.  A special local need is defined under 40 CFR, Part 162, subpart D, as "an existing or imminent pest problem within a state for which the state lead agency has determined that an appropriate federally registered product is not sufficiently available."  The registrant must then provide MDA with one copy of residue and product toxicology data to support the proposed use as well as five copies of the proposed SLN label.

There are no additional fees due for 24(c) special local needs registrations as long as the parent product is currently registered with the state.  24(c) registrations are valid for a period of five years.

25(b) Exempted Pesticides

Michigan law requires that all products which make a pesticidal claim must be registered with the state.  The state defines a pesticide as "a substance or mixture of substances intended for preventing, destroying, repelling or mitigating pests or intended as a plant regulator, defoliant, or desiccant."  A pest is defined as "an insect, rodent, nematode, fungus, weed and other forms of terrestrial or aquatic plant or animal life or virus, bacteria, or other microorganism, except viruses, fungi, bacteria, nematodes or other microorganisms in or on living animals."

Therefore, 25(b) exempted products are subject to the same registration requirements as section 3 registered products, i.e., registrants must annually submit a registration fee, a groundwater protection fee and a product label for each product registered.

Chemical Sterilants

Michigan no longer registers liquid chemical sterilants exempted from federal registration under the Food Quality Protection Act.  EPA-registered products continue to require Michigan registration.

Discontinuance Period

A registrant who intends to discontinue a pesticide registration must do one of the following:

• Terminate further distribution within the state and continue to register the pesticide annually for two successive years.  Discontinued products incur the same registration and ground water protection fees, and label requirements as do active products.
  
  
• Initiate a recall of the pesticide from distribution in the state within 60 days of the date of notification to MDA.

Experimental Use Permits (EUPs)

The registrant must notify MDA when an experimental use permit has been granted by EPA and provide a copy of the letter from EPA granting the permit, a summary of the experimental program and the list of cooperators (names, addresses and counties) to MDA prior to application of the product.

There are no registration fees or groundwater protection fees due for pesticides used under an experimental use permit.

Label Requirements

Registrants must submit one product label for each product registered.  A full set of labels must be submitted annually with the renewal application.  In addition, if a registrant is registering a supplementally-registered product, they must also submit a copy of the EPA form 8570-5 "Notice of Supplemental Registration" with their application.

Late Fees

Payment for pesticide renewals must be mailed to the MDA office by June 30th in any given registration year or a $100 per product late fee will be incurred.  In addition, if products which were once registered with the state are found in the channels of trade and have not been renewed for one or more years, back registration fees, groundwater protection fees and late fees will be assessed for those years up through the current registration year.

Registration Period

The Michigan pesticide registration period is July 1 through June 30.  Registration fees and groundwater protection fees cannot be prorated.

Renewals

In March or April the renewal listings are mailed for the upcoming registration year. Our registration year runs from July 1st to June 30th. Every year at renewal we require the renewal listing to be completed and attached with the proper fees ($40 in registration and $100 or $150 in groundwater protection depending on the product classification) and a copy of marketplace label for each pesticide. We require renewals to be forwarded to the office of the director by no later than July 1st to the following address, or late fees ($100 per pesticide product) are also due. Renewal remittance needs to be forwarded to: Michigan Department of Agriculture, PO Box 30776, Lansing, MI 48909-8276.

Pesticide Groundwater Protection Fee

The groundwater protection fees are based upon the designation of the pesticide as specialty or non-specialty.  See the next section for information on designation.

Specialty Products: $100 per product

Non-Specialty products: 0.75% of the wholesale value of the product sales for use in the state of Michigan. A $150 minimum fee is due at time of registration with the balance (if applicable) due before October 1 of the next registration year. (The Michigan registration year is July 1-June 30.) Registrants will receive a listing of their products which have been designated as "non-specialty" approximately one month prior to the October 1^st due date.

Groundwater protection fees are owed annually for all pesticides distributed or offered for sale in the state of Michigan, including those exempted from federal registration under 25(b) of FIFRA.
