DECEMBER 04, 2002 - The Michigan Department of Consumer & Industry Services (CIS), Bureau of Family Services has issued an order of summary suspension and notice of intent to revoke action to Kalamazoo County group day care home provider, Angelina Leyva, 1922 Commonwealth, Kalamazoo, Michigan.  Angelina Leyva has been ordered to immediately cease providing care to children effective 6:00 P.M. on Wednesday, December 4, 2002.  This action is the result of a recent complaint investigation of the group day care home.

Under Michigan statute, a Group Day Care Home is defined as “a private home in which more than 6 but not more than 12 minor children are given care and supervision for periods of less than 24 hours a day, unattended by a parent or legal guardian, except children related to an adult member of the family by blood, marriage, or adoption.  Group day care home includes a home that gives care to an unrelated minor child for more than 4 weeks during the calendar year.”

The December 3, 2002 findings of the complaint investigation found that:

·       On November 25, 2002, on or about 1:00 p.m., a 3-year-old child care child was found running down a busy street with her coat half off and her shoes off.  The child was picked up by a neighbor, who then called the police. 

·       The licensee failed to notify either the police or the child’s mother when she became aware of the missing child at approximately 1:30 p.m.  The mother reported the child missing when she arrived to pick up the child and was then informed by the licensee that the child was missing.  The police informed the mother that they had possession of the child for hours.

Effective 6:00 P.M December 4, 2002, the Summary Suspension Order requires Angelina Leyva not to operate a Group Day Care Home at 1922 Commonwealth, Kalamazoo, Michigan or at any other address or location.  Children are not to be received for care after that date or time.  The order also requires Angelina Leyva to inform all of the parents or guardians of children in care that her license has been suspended and that she can no longer provide child care.

Angelina Leyva has held a license to operate a Group Day Care Home since October 1, 2002.  The license was for 12 children.
