Kevorkian Subpoened to Release Records on the Practice of Medically-Assisted Suicide

Contact:  Maura Campbell 517.373.9280
Agency: Labor & Economic Growth

JULY 16, 1998 - Consumer & Industry Services Director Kathleen M. Wilbur today announced that CIS has served Jack Kevorkian with a subpoena demanding he produce any and all records related to his practice of medically-assisted suicide or "Patholysis."

The order pertains to the 42 patients he has treated since the department's April 1997 Cease and Desist Order directing him to immediately stop practicing medicine without a license.

"We believe these records will prove beyond a doubt that he has continued to practice medicine without a valid medical license defying the Cease and Desist Order we issued last year," said Wilbur.

The subpoena, signed on behalf of Consumer & Industry Services by the Michigan Attorney General's office, was approved by Ingham County Circuit Judge Lawrence M. Glazer on July 8, 1998. Kevorkian was served July 16, 1998.

In part the subpoena orders Kevorkian to produce "Any and all records including but not limited to medical records...patient/physician consultations...records relied upon to make treatment decisions, and evaluations completed...related to the practice of Patholysis."

Kevorkian must submit these records to CIS no later than 2 p.m. Friday, July 24, 1998 or risk being held in contempt of court which could result in jail time.
