Information on Marina Operating Permit Program

On 11/4/2009 House Bill 5055 was enacted as 2009 P.A. 139. These amendments to Part 301, Inland Lakes and Streams, of the NREPA took immediate effect. The requirement for a Marina Operating Permit was rescinded. Construction, expansion, or reconfiguring a marina requires a construction permit. These amendments also added additional construction permit review criteria which were previously in the Part 301 administrative rules for marina operating permits. Existing marinas whose current mooring configurations were not authorized by a construction permit issued by the DNRE must apply for a construction permit when they expand or reconfigure their marina or by January 1, 2012, whichever comes first.

Rule 9 (R 281.819) of the Administrative Rules for Inland Lakes and Streams was rescinded on April 28, 2010. This rule covered the processing of marina operating permit applications.
