Division staff routinely review and monitor persons' compliance with state environmental statutes and rules relevant to contaminated sites, undertake steps to secure the recovery of the state's response activity costs from liable parties, and provide assistance on liability issues to facilitate brownfield redevelopment.

Issues of non-compliance or violation of state environmental laws and requirements and cost recovery are typically resolved through voluntary actions. When appropriate, such actions are embodied in legally enforceable agreements (e.g., Remedial Action Plan Implementation Agreements, Administrative Orders by Consent, and Consent Decrees).

When necessary, escalated enforcements actions, which may include civil actions, may be undertaken to address significant non-compliance issues or imminent and substantial threats to public health, safety or welfare, or the environment.
